Privilege log questions
What is a privilege log?
A privilege log is the list a party serves when it withholds documents from discovery as privileged. Each entry identifies one document (usually by Bates number, date, type, author and recipients), names the privilege claimed, such as attorney-client or work product, and describes the document enough for the other side to assess the claim without revealing the privileged content. In federal court, Rule 26(b)(5)(A) of the Federal Rules of Civil Procedure requires that description.
What goes in a privilege log?
Most logs carry the same columns: a log number, the Bates number or document ID, the date, the document type, the author, the recipients (including copies), the privilege asserted, and a description of the subject matter. Tabzoola's privilege log maker on this page uses those columns; courts and local rules sometimes require more, such as the basis for the privilege or a categorical format, so check your court's rules and any order in the case.
What is a privilege log example?
The maker opens with three example entries: an email asking in-house counsel for legal advice (attorney-client), a litigation memorandum from outside counsel (attorney-client and work product), and a draft letter with counsel's notes (work product). Each description says what the document is about without disclosing the advice itself. Clear them and add your own.
Can I make the privilege log in Excel?
