## What the appellate rules say about appendix tabs

Several appeals courts require a tab on each appendix document in the paper copy, quoted here from each court's own rules:

- Texas, Tex. R. App. P. 9.4(h): "A paper record in an original proceeding or a paper appendix must be tabbed and indexed."
- Kentucky, Ky. RAP 32(E)(1)(d): "The items in the appendix shall be separated by appropriate extruding tabs."
- 11th Circuit, 11th Cir. R. 30-1(e): "Indexing tabs shall be affixed to the first page of each document in the appendix to identify and assist in locating the document." Its operating procedures stagger the tabs down the right-hand side and number them by district court docket number.
- 5th Circuit, 5th Cir. R. 30.1.7(c): paper record excerpts must "Be tabbed to correspond to the numbers assigned in the table of contents".
- South Dakota, SDCL 15-26A-60(8): "Sections of the appendix shall be tabbed and salient information highlighted."
- Alabama, Ala. R. App. P. 21(a)(1)(G), mandamus petitions: "each document within the appendix shall be separated by a divider and appropriate tab to identify and assist in locating the documents."
- California, Cal. Rules of Court 8.486(c)(1)(B), documents supporting a writ petition: "If submitted in paper form, they must be index-tabbed by number or letter."
- 2nd Circuit, 2d Cir. L.R. 32.1(b)(4): "Tabs may be used to separate documents in the appendix."

## Where tabs are not allowed

Some appellate courts ban tabs on the filed paper, and two that require them want a different copy left plain. Texas, Tex. R. App. P. 9.3(a): the unbound copy of an appendix "must not include tabs that extend beyond the edge of the page." Kentucky, Ky. RAP 31(F)(1): "The unbound copy shall replace extruding tabs with separator pages." Washington, RAP 18.17(a)(1): "Documents should not contain tabs". Hawaiʻi, Haw. R. App. P. 32(a), and the Louisiana Courts of Appeal, Unif. R. 4-5(B), also bar them on filed papers.

Montana, M.R.App.P. 12, asks for plain paper tabs in an appendix: "each document shall be tabbed using plain paper tabs and not plastic-coated tabs." Tabzoola's online paper sets carry clear Mylar on every tab, which a Montana appendix can't use, so Tabzoola prints plain paper tabs with no Mylar for Montana filings: ask for them through the quote form at tabzoola.com/quote. The full list, over a hundred courts, is in Tabzoola's court exhibit tab rules guide; Tabzoola prints tabs and does not give legal advice, so check the current rule and the clerk's notices before filing.

## Numbered, lettered or docket-numbered

Type what the appendix's table of contents uses. Numbers (Tab 1 to Tab 40), letters (A to Z, then AA), docket numbers ("Doc. 112", "ECF 45") or short document names ("Final Judgment", "Jury Charge") all print the same way and cost the same, up to two lines per tab. A long appendix runs in staggered banks down the right-hand edge; Tabzoola also prints bottom tabs where a court wants them there.

Order the tabs unpunched when the appendix will be bound, or 3-hole punched for a binder copy. Each set is collated, so every copy for the court, opposing counsel and the file comes out in the same order.
